The Spinney Press Terms And Conditions

The following terms and conditions govern the use of this website, your interactions with The Spinney Press and the collection and use of your personal information by The Spinney Press.

1. PRIVACY AND SECURITY

The Spinney Press collects your personal details and usage information to process your transaction, for internal review, or to assist in providing or improving the website and The Spinney Press's service, or to share with other people or organisations who assist The Spinney Press in providing our product to you. We may also disclose your personal information to a third party or distributor to enable the delivery of goods or services to you. Otherwise we do not disclose personal information unless we are required by law, regulation, an applicable industry code, for safety reasons or where we reasonably believe that you are in breach of these terms and conditions or are engaged in illegal activities.

If you do not want The Spinney Press to forward commercial information relating to our products or services which The Spinney Press believes may be of interest to you please opt out by contacting admin@spinneypress.com.au.

The Spinney Press does not hold your credit/debit card information for orders made via its website. This information is directed to Payment Express or PayPal who ensure the highest security for the processing of your credit/debit card transactions and guarantee your details will not be used fraudulently.

2. CONDITIONS OF PURCHASE

It is assumed that you have read, understood and have accepted the conditions of purchase as listed below, in ordering from The Spinney Press:

Credit/Debit Card Payment:

The customer's card is debited by Payment Express or PayPal at the time of processing the purchase. After reviewing order details, the customer may opt to proceed to payment. The customer will then be linked to Payment Express or PayPal. After entering their credit card details (Visa or Mastercard only), the customer receives a message from Payment Express or PayPal as to the success or failure of their transaction as conveyed to the www.spinneypress.com.au website.

The Spinney Press does not have access to card details unless a customer contacts the Accounts Department at The Spinney Press to complete an order on their behalf. In this case the customer's card details will be entered onto the system by the Accounts Department but the information is not stored by The Spinney Press.

Data is encrypted for the customer's safety. The Spinney Press cannot be held responsible for a security failure originated with Payment Express or PayPal.

(i) Print Books

The Spinney Press will email you with confirmation of the receipt and acceptance of your order. The Spinney Press at its sole discretion may rescind acceptance, in whole or in part, of any order containing incorrect information, whether this results from technical malfunction or any other cause, or in cases where the order is in conflict with the conditions of purchase. Items on one order are sent to the same delivery address.

Cancellation

You may cancel your order (in whole or in part) within 24 hours of ordering by contacting The Spinney Press at orders@spinneypress.com.au or calling +61 2 4268 5600, Monday to Friday 9.00 am to 5.00 pm (AEST). Once you cancel an order any sums due to you will be re-credited to your account within 14 days. If your order has already been shipped, please refer to Returns and Refunds below.

Price and availability information may change without notice. Subject to an order being made on or after publication, if an item increases in price during the period between order and dispatch, The Spinney Press pays the difference on behalf of the customer.

Returns and Refunds

Refunds and returns are not accepted by The Spinney Press unless the customer has received an unordered item, or an item damaged in transit, or a faulty item. We aim to provide replacement copies of undelivered or returned items when requested, but The Spinney Press is only obligated to refund purchase costs. Please note that The Spinney Press will not refund returns postage and packing charges:

Please do the following:

  • Make a note for your reference of the invoice number and item number/Volume/ISBN(s) printed on the invoice.
  • Contact customer service at orders@spinneypress.com.au or by calling +61 4268 5600.
  • Return the item(s) with the original dispatch note in the original packaging.

Inspection Copies of Spinney Press Titles

If teachers and lecturers are considering adopting an educational title into a course an inspection copy is available. If 10 or more titles are consequently ordered, the inspection copy may be retained free of charge. If an adoption does not occur inspection copies must be returned at your sole cost in mint condition with the accompanying invoice within 14 days of the inspection copy order – any failure to do this will result in your account being debited for the invoiced amount.

(ii) Digital Editions ("e-books")

The Spinney Press will email you with confirmation of the receipt and acceptance of your order. The Spinney Press at its sole discretion may rescind acceptance, in whole or in part, of any order containing incorrect information, whether this results from technical malfunction or any other cause, or in cases where the order is in conflict with the terms and conditions of purchase.

Customers have 14 days from the time of purchase to download an e-book, before the download link times out.

Customers are not entitled to refund or return an e-book. The Spinney Press will resupply corrupted, incomplete or incorrectly supplied e-books if notified within 48 hours of purchase. The Spinney Press will not resupply an e-book that has been lost due to system failure, accidental deletion or other causes beyond The Spinney Press’s control. It is the customer’s responsibility, once supplied, to ensure the security and integrity of the e-book files, within the limitations of the licence granted on purchase of the e-book.

Supply

The Spinney Press reserves the right at its sole discretion not to supply certain customers, or customers in certain countries, or to apply any limitations of quantity or value deemed appropriate.

3. COPYRIGHT

Unless otherwise stated, all content appearing on The Spinney Press website including text, images, audio, video, computer code and software, as well as Spinney Press logos and trademarks, are the copyright and sole property of The Spinney Press and/or its subsidiaries, affiliates or related companies. Unauthorised use is an infringement of Australian and foreign intellectual property laws.

Except for personal reference, content may not be downloaded, copied, reproduced, republished, modified, posted, sold, reused, translated or distributed in any form or by any means without the prior written permission of The Spinney Press.

If you wish to obtain permission to use material from the website, please contact The Spinney Press at admin@spinneypress.com.au. This excludes the downloading of one copy of an extract from the website on a single computer for personal, non-commercial use, with copyright and proprietary notices.

Disclaimer of Warranties and Limitation of Liability

The Spinney Press makes no representations or warranties of any kind, expressed or implied, as to the operation of this website or the information, content, materials or products included on this website. You expressly agree that your use of this website is at your sole risk and all materials and information on the website are for your personal, non-commercial use.

To the full extent permissible by applicable law, The Spinney Press disclaims all warranties, expressed or implied, including but not limited to merchantability and fitness for a particular purpose. The Spinney Press does not warrant that this website, its servers, or email sent from The Spinney Press are free of viruses or warrant its uninterrupted availability. The Spinney Press will not be liable for any damages of any kind arising from the use of this website, including without limitation direct, indirect, incidental, and consequential damages, and loss of business or profits.
